General terms and conditions

Article 1. Definitions

1.1. PsyPerspectief: Refers to the individual person or organization that has requested the service provider to provide services in the field of psychological guidance or related activities.

1.2. The client: Refers to the person participating in a guidance program in the field of psychological guidance or related activities.

Article 2. Applicability of the Agreement

2.1. These general terms and conditions apply to all agreements and registrations, whether entered into orally, in writing, or through the website, between PsyPerspectief and the client. Deviations from these general terms and conditions are only valid if agreed upon in writing and explicitly with PsyPerspectief prior to registration. 2.2. PsyPerspectief reserves the right to modify these general terms and conditions. The client agrees that the most recent version of these general terms and conditions, available on the website, is applicable between PsyPerspectief and the client.

Article 3. Financial Agreements

3.1. PsyPerspectief will send invoices via email.

3.2. Within one to seven days after each session, PsyPerspectief will send an invoice to the client.

3.3. Rates for the provided services are agreed upon at the beginning of the treatment process between PsyPerspectief and the client.

3.4. Payment of invoices must be made within 14 days of the invoice date, as indicated on the invoice.

3.5. Offsetting payments is not allowed. Costs must be paid based on the services provided, regardless of the achieved results.

3.6. If the client does not pay the due amount within 14 days of the invoice date, the client is considered to be in default.

3.7. If the client has not paid the due amount within fourteen days of the invoice date, PsyPerspectief will send a payment reminder free of charge. The client will be informed of the collection costs that will be charged after fourteen days. These costs are borne by the client.

3.8. If the client has still not fulfilled his/her obligations within 14 days of the payment reminder, PsyPerspectief reserves the right to take collection measures or engage third parties for this purpose without further notice.

3.9. All judicial and extrajudicial costs related to the collection of the amounts due are borne by the client. Extrajudicial costs amount to a maximum of 15% of the amount to be claimed, with a minimum of €40.

3.10. Persistent disputes over payment may strain the trust relationship between the client and PsyPerspectief. This may lead PsyPerspectief to suspend or terminate the professional relationship if it deems there is a "weighty reason" for termination.

Article 4. Copyright and Intellectual Property

4.1. Reuse of text, photos, or other materials from this website is not allowed without the explicit written permission of PsyPerspectief. The copyright and intellectual property of these materials belong to PsyPerspectief.

4.2. All documents and materials provided by PsyPerspectief, including educational materials, exercises, reports, and advice, are solely intended for use by the client and may not be reproduced, disclosed, or provided to third parties without the express written consent of PsyPerspectief.

Article 5. Force Majeure and Termination

5.1 The payment term for invoices is 14 days from the invoice date, and payment must be made in the manner indicated by the service provider. Payment must be made without any form of discount, setoff, or suspension.

5.2. If 14 days have passed since the invoice date without receiving payment, the client is automatically in default without further notice being required. In that case, the service provider has the right to suspend the execution of the agreement.

5.3. From the moment of default, the client is liable for delay interest equal to the legal interest rate.

5.4. If there are multiple clients, they are jointly and severally liable for the payment of the total invoice amount if the services have been performed for all these clients.

5.5. Payments made by the client are first allocated to the due interest and costs, and then to the oldest outstanding invoices, even if the client states that the payment relates to a later invoice.

Article 6. Liability

6.1. Unless there is intent or gross negligence on the part of the client, PsyPerspectief accepts no liability for any direct or indirect damage that arises during or as a result of the execution of the assignment, regardless of the cause.

6.2. Except for intent or gross negligence on the part of PsyPerspectief, PsyPerspectief accepts no liability for any direct or indirect damage resulting from actions or decisions taken during or in connection with the assignment, or for damage to the client's property, regardless of the cause. The client remains at all times responsible for the choices he or she makes.

6.3. Unless there is intent or gross negligence on the part of PsyPerspectief, PsyPerspectief accepts no liability for any direct damage suffered by the client as a result of the non-completion or incomplete completion of the assignment.

6.4. The liability of PsyPerspectief is limited to a maximum of the amount of the fee for the services to be provided, or that part of the assignment to which the liability relates.

Article 7. Appointments

7.1. If the client is late for an (online) consultation, the duration of the session will be shortened by the elapsed time.

7.2. Appointments must be canceled at least 24 hours before the scheduled time of the consultation. In the absence of cancellation, or if the cancellation occurs within 24 hours of the scheduled appointment, PsyPerspectief reserves the right to charge the time reserved for the client.

Article 8. Website

8.1. Rates for services can be found on the website www.psyperspectief.nl. PsyPerspectief strives for the most accurate representation of prices and reality. Any errors occurring due to programming or typographical errors are not a basis for entering into an agreement with PsyPerspectief.

8.2. PsyPerspectief endeavors to keep the website www.psyperspectief.nl as up-to-date as possible. Nevertheless, PsyPerspectief cannot accept liability for incomplete and/or incorrect information or content on the website.

8.3. PsyPerspectief reserves the right to modify, remove, or repost materials on the website www.psyperspectief.nl without prior notice.

8.4. PsyPerspectief accepts no liability for information on the website www.psyperspectief.nl that is referred to via hyperlinks.

Article 9. Personal Data

9.1. By entering into an agreement with PsyPerspectief, the client gives consent for the automated processing of personal data arising from the agreement. PsyPerspectief will use this personal data exclusively for its own purposes.

9.2. The client's data is treated with the highest confidentiality and may not be disclosed to third parties without the explicit consent of the client.

Article 10. Contact

10.1. Communication between PsyPerspectief and the client takes place via email, phone, and/or personal meetings.

10.2. Online consultations are conducted via a secure video connection accessible through laptops, tablets, or smartphones.

Article 11. Complaints Procedure

11.1. At PsyPerspectief, we strive to meet the expectations of our clients. If a client has complaints regarding the provided services or products, we request them to make these complaints known in writing to PsyPerspectief. This can be done via info@psyperspectief.nl.

11.2. After receiving and discussing the complaint with the client, PsyPerspectief will make efforts to find and implement the best possible solution.

Article 12. Dispute Resolution

12.1. Dutch law applies to all agreements and legal acts between the client and the service provider.

12.2. In case of a dispute between the service provider and the client resulting from this agreement, both parties are obligated to first attempt to resolve the dispute through mutual consultation. If this does not lead to a satisfactory solution, mediation will be attempted first.

12.3. If mutual consultation and mediation do not lead to a resolution of the dispute, the competent judicial authority in the location where the service provider is established will have exclusive jurisdiction to adjudicate the dispute.
